Terms & Conditions (kyodan.ca)

 Effective date: July 27, 2025

These Terms and Conditions (“Terms”) govern your use of the kyodan.ca website and any purchases made through it (the “Service”), operated by Kyodan (“Kyodan”, “we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.


1) Purchases & Payments

  • You may be asked for payment and order details (e.g., card number, expiry date, billing and shipping addresses). You represent that you are authorized to use the chosen payment method and that all information you provide is true and complete.
  • You authorize us to share your information with third-party processors to complete your order.
  • All prices on kyodan.ca are in Canadian dollars (CAD) unless stated otherwise. Applicable Canadian taxes are calculated at checkout for Canadian orders.
  • We may refuse or cancel any order at any time for reasons including: suspected fraud or unauthorized activity, product availability, pricing or description errors, or issues with your order details.
  • If an order is cancelled after your payment is captured, we will process a refund to your original payment method.

2) Availability, Errors & Changes 

We work to keep information accurate, but we cannot guarantee completeness or error-free content (including prices, images, specs, availability). We may correct errors or update information at any time without prior notice.


3) Shipping & Delivery 

3.1 Where We Ship

We ship within Canada and to the following international destinations: Austria, Belgium, France, Germany, Greece, Hungary, Ireland, Italy, Netherlands, Poland, Portugal, Spain, Switzerland, United Kingdom, Australia, and New Zealand.

We do not ship to the United States from kyodan.ca. Orders placed with a U.S. shipping address will be cancelled.

3.2 Processing Times

Orders are typically processed within 2 business days (Monday–Friday, excluding Canadian & Quebec statutory holidays). Processing time is separate from carrier transit time.

3.3 Carriers

We primarily ship with FedEx. For some Canadian addresses, we may use Canada Post. Carrier selection is at our discretion.

3.4 Delivery Estimates

Estimated delivery dates shown at checkout begin after your order ships and depend on destination, service level, weather, customs, and carrier capacity. International deliveries may experience customs delays. 

3.5 Duties, Taxes & Import Fees (International)

For international orders, you are responsible for all import duties, taxes, brokerage, and fees charged by the destination country. Unless explicitly stated otherwise, we ship Delivered Duties Unpaid (DDU).

3.6 Address Requirements & Delivery Issues

  • Provide a complete and accurate shipping address. We are not responsible for non-delivery due to incorrect or incomplete addresses.
  • Some carriers cannot deliver to P.O. Boxes for international shipments.
  • If a package is refused, unclaimed, or returned due to address issues, we may deduct original and return shipping (and any carrier or customs charges to return the package) from your refund.
  • Title and risk of loss pass upon delivery to the address you provide. If tracking shows delivered but your package is missing, contact the carrier, then contact us promptly with details.

International Orders & Customs

International shipments are sent Delivered Duties Unpaid (DDU). The recipient is responsible for all import duties, taxes, brokerage, and local fees. Delivery estimates exclude customs processing. A physical address and contact phone may be required. For undeliverable, refused, or unclaimed parcels, we may deduct original and return shippingplus any carrier/customs charges from the refund. For returns from outside Canada, the customer pays return shipping; any duties/taxes paid to local authorities are not refundable by Kyodan.

3.7 Tracking

When your order ships, we will send a shipping confirmation with tracking (where available).


4) Order Changes & Cancellations

We start preparing orders quickly and cannot guarantee changes or cancellations once an order is in processing or shipped. If you need help, contact us immediately after placing your order.


5) Returns & Exchanges

5.1 Standard Return Window

You may return eligible items within 30 days of delivery for a refund to the original payment method, subject to these conditions:

  • Items must be new, unworn, unwashed, and free of odors or stains.

  • Items must have all original tags/packaging attached.

  • Final Sale items and certain hygienic items (e.g., bodysuits) are not returnable.

  • Original outbound shipping charges from your order are non-refundable.

5.2 Return Shipping Costs

  • Within Canada: For returns requested within 30 days of delivery, we provide a prepaid return label at no charge. If you choose to use your own carrier instead of our provided label, you are responsible for the shipping cost and risk of loss.

  • International orders: You are responsible for the cost of return shipping back to our designated warehouse(s). Please contact Customer Service for instructions before shipping your return.

5.3 Duties & Taxes on Returns (International)

Any import duties, taxes, or carrier fees paid to your local authorities or carrier are not refundable by Kyodan. You may be able to request a refund from your local authority, where applicable.

5.4 Exchanges

Exchanges are subject to stock availability. In many cases, the fastest option is to return the original item and place a new order. If a size exchange is available for your item, we’ll provide instructions during your return request.

5.5 Promotions & Adjustments on Returns

  • If your return reduces the order below a promotion threshold, your refund may be adjusted (see Promotions section).

  • For Gift With Purchase (GWP), you must return the gift when your return causes the order to fall below the threshold; otherwise we may deduct the gift’s retail value (e.g., $58 CAD where applicable).

  • Returned items must meet Section 5.1 conditions. Items received outside policy may be returned to you at your expense.


6) Promotions

6.1 General Promotion Rules

Promotions are limited-time, while supplies last, and may not be combined with other offers unless stated. One promotion/discount may apply per order. We may verify eligibility and void unauthorized discounts. We may modify or cancel promotions at any time.

 6.2 Gift With Purchase (GWP)

When a GWP promotion is active:

  • One gift per qualifying order that meets the stated threshold (before taxes, shipping, and fees).
  • Gifts cannot be returned or exchanged on their own.
  • If you return items and the remaining order no longer meets the threshold, you must return the gift as well or we may deduct the gift’s retail value from your refund (e.g., $58 CAD for Kyodan Recovery Slides, where applicable).

(Note: Past GWP events may have specific dates and terms. If those events have ended, the terms apply only to orders placed during the stated promotion period.)

 6.3 Buy 2 Get 1 Free

  • Add 3 items to cart; the lowest-priced item becomes free at checkout.
  • Not valid with other offers.
  • If you return any items from a Buy 2 Get 1 Free order, you must also return the free item, or your refund will be adjusted to reflect the offer no longer applying. Size exchanges for the same item may be allowed when in stock.

6.4 Affiliate Codes

  • One affiliate code per order.
  • Orders using multiple/stacked codes may be reviewed and unauthorized discounts voided.

7) Accounts

You are responsible for maintaining the confidentiality of your account and password and for all activities under your account. Notify us immediately of any unauthorized use or security breach.


8) Intellectual Property

All content on the Service (text, images, graphics, code, etc.) is owned by Kyodan and protected by applicable laws. You may display, copy, download, or print portions only for personal, non-commercial use or to place an order with Kyodan. Any other use is prohibited. These Terms do not grant rights to use Kyodan trademarks. Do not remove proprietary notices from materials.


9) Third-Party Links

The Service may link to third-party websites or services we do not control. We are not responsible for their content, policies, or practices. Access them at your own risk and review their terms and privacy policies.


10) Indemnification

You agree to indemnify and hold harmless Kyodan and its affiliates, officers, directors, employees, contractors, licensors, suppliers, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or activities under your account.


11) Limitation of Liability

To the maximum extent permitted by law, Kyodan and its affiliates will not be liable for any indirect, incidental, special, consequential, punitive, or economic damages, or for any loss of data, goodwill, or other intangible losses, arising from or related to your use of (or inability to use) the Service, any third-party content or conduct, or unauthorized access to your transmissions or content—even if advised of the possibility of such damages.


12) Disclaimer

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance, except where such warranties cannot be excluded under applicable law. We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or free of harmful components.


13) Consumer Rights & Exclusions

Some jurisdictions (including Quebec) may not allow certain warranty exclusions or limitations of liability. In such cases, the applicable provincial or national law will apply to the extent required, and these Terms will be read to comply with those laws.


14) Governing Law

These Terms are governed by the laws of the Province of Quebec and the laws of Canada, as applicable. If any provision is found invalid or unenforceable, the remaining provisions remain in full force. These Terms constitute the entire agreement between you and Kyodan regarding the Service.


15) Changes to These Terms

 We may update these Terms at any time. If a change is material, we will make reasonable efforts to provide at least 30 days’ notice before new terms take effect. By continuing to use the Service after changes become effective, you agree to the revised Terms.
