Kyodan (“Kyodan”, “we”, “us”, or “our”) operates the https://www.kyodan.ca/ website and related services (the “Service”). This Privacy Policy explains how we collect, use, disclose, and protect your personal information, and the choices you have.

By using the Service, you agree to this Privacy Policy and our Terms & Conditions.

1) Who we are (Data Controller)

We primarily serve Canada and selected international destinations (see Shipping Policy). We do not ship to the United States from kyodan.ca.

2) What we collect

We collect information directly from you, automatically, and from service providers.

Information you provide

Contact & account: name, email, phone, billing/shipping addresses, account credentials.
Orders & returns: items purchased/returned, order numbers, delivery details, gift cards, communications.
Payments: last 4 digits/brand/token from processors (we do not store full card numbers).
Preferences & communications: marketing opt-ins, survey responses, customer support messages.
Contest/giveaway entries: social handles and content you submit (see Contests & Giveaways rules).

Information collected automatically

Device & usage: IP address, browser/device type, pages viewed, time stamps, referring pages/UTM, approximate location (derived from IP), error logs.
Cookies/SDKs/pixels: see Cookies & similar technologies.

Information from service providers

Payment processors (e.g., PayPal/Braintree), fraud-prevention tools, analytics, shipping/warehousing and returns platforms, email/SMS providers, and marketing platforms.

3) How we use your information

Provide the Service: process orders/returns, deliver products, provide customer support.
Account & personalization: remember preferences, saved items, recently viewed.
Payments & fraud prevention: authorize transactions, detect/prevent abuse or security incidents.
Communications: order confirmations, shipping updates, policy changes, and—if you opt in—marketing(email/SMS). You can unsubscribe at any time.
Analytics & improvement: understand performance, diagnose issues, improve site/app.
Legal compliance: tax/audit requirements, responding to lawful requests, enforcing terms.

Legal bases (EEA/UK where applicable): contract performance, legitimate interests (e.g., security, analytics, marketing to existing customers), consent (for certain cookies/marketing), and legal obligations.

4) Cookies & similar technologies

We use cookies, pixels, and SDKs to:

Advertising/retargeting: show relevant offers (where permitted).

5) How we share information

We do not sell your personal information. We share it only as needed:

Service providers (processors): payments (PayPal/Braintree), shipping carriers/warehouses, returns portal, customer support tools, email/SMS platforms, analytics/anti-fraud, and marketing platforms—only to perform services on our behalf.
Legal & safety: to comply with law, enforce our terms, or protect rights, safety, and property.
Business transfers: as part of a merger, acquisition, financing, or sale of assets (we’ll notify you where required).

6) International transfers

Your information may be processed in countries outside your own (including Canada, the EU/UK, and other locations where our providers operate). Where required, we use appropriate safeguards (e.g., Standard Contractual Clauses) to protect cross-border transfers.

7) Retention

We keep personal information as long as necessary for the purposes described above, including:

Orders/returns/tax records: typically up to 7 years (or longer if laws require).
Accounts & marketing preferences: until you delete your account or withdraw consent/opt out.
Analytics/security logs: for operational needs and security, then anonymized or deleted.

8) Your choices & rights

Marketing: You can unsubscribe from marketing emails using the link in our messages, or contact us at hello@kyodan.ca. (Transactional emails will still be sent for your orders.)

Cookies: Adjust browser settings and/or use our [Cookie Settings] tool.

Access, correction, deletion (Canada/Québec): You may request access to or correction of your personal information. Québec and Canadian residents can also lodge a complaint with the Office of the Privacy Commissioner of Canada or the Commission d’accès à l’information du Québec.

EEA/UK (GDPR): You have the right to access, rectification, erasure, restriction, objection, and data portability, and to withdraw consent at any time (without affecting prior processing). You may lodge a complaint with your local supervisory authority.

We may verify your identity before responding.

9) Security

We use administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission or storage is 100% secure.

10) Children’s privacy

Our Service is not intended for individuals under 18. We do not knowingly collect personal information from anyone under 18. If you believe a minor provided information, contact support@kyodan.ca and we will delete it.

11) Third-party links

Our Service may link to third-party sites/apps we don’t control. Review their privacy policies—our policy does not apply to them.

12) Payments

We use third-party payment processors. We do not store full card details. Their use of your data is governed by their privacy policies. Current processors include:

If you select a “buy now, pay later” option (e.g., Afterpay), that provider acts as a separate controller and will present its own terms and privacy policy.

13) Contests & giveaways

If you participate in a promotion, we process your entry information as described in the Contests & Giveaways rules (e.g., social handles/content, eligibility checks, winner administration). Some promotions may have additional terms that supplement this policy.

14) Region-specific notices

Do Not Track (CalOPPA): Some browsers send a DNT signal; we currently do not respond to DNT.

International orders (EU/UK/AU/NZ, etc.): We ship DDU (Delivered Duties Unpaid). Customs authorities/carriers may process your personal information for import clearance and local delivery under their own policies.

15) Changes to this Privacy Policy

We may update this policy from time to time. We will post the updated version here and update the effective date. For material changes, we will provide additional notice (e.g., on-site banner or email, where appropriate).
